If you’ve been involved in a motor vehicle accident in Ontario, you are entitled to no-fault accident benefits regardless of fault. However, the amount and duration of those benefits depend heavily on the severity of your injuries.
When your injuries are especially serious, you may qualify for a Catastrophic Impairment designation. This classification can dramatically expand the accident benefits available to support your recovery and long-term care.
Benefit Limits (Standard Coverage)
Unless you have purchased optional enhanced benefits, access to medical, rehabilitation, and attendant care benefits is determined by your injury classification:
Minor Injuries: Up to $3,500 for medical and rehabilitation benefits.
Non-Catastrophic Injuries: Up to $65,000 combined for medical, rehabilitation, and attendant care benefits.
Catastrophic Impairments: Up to $1,000,000 for medical, rehabilitation, and attendant care benefits.
In short, securing a catastrophic impairment designation can make a life-changing difference in the funding available for your ongoing treatment, rehabilitation, and support needs.
What Qualifies as a Catastrophic Impairment?
The criteria for a catastrophic impairment are defined in Section 3.1 of the Statutory Accident Benefits Schedule. There are eight categories:
Criteria 1–5 (Specific Severe Injuries)
These include:
Paraplegia or quadriplegia
Amputation or complete loss of use of one or more limbs
Total loss of vision in both eyes
Severe brain injuries
Criterion 6: Physical Impairments
Your physical injuries result in a Whole Person Impairment (WPI) rating of 55% or higher, as assessed under the American Medical Association’s Guides to the Evaluation of Permanent Impairment (4th edition, 1993).
Criterion 7: Combined Physical and Psychological Impairments
A combination of physical and psychological impairments that together reach the 55% WPI threshold.
Criterion 8: Serious Mental or Behavioural Disorders
Your condition significantly impairs functioning in three out of four areas of life, or completely prevents useful functioning in one area. The four spheres are:
Activities of daily living
Social functioning
Concentration, persistence, and pace
Adaptation to work-like settings
Assessing WPI ratings or the four spheres of functioning is highly technical and requires evaluation by qualified medical experts
What This Means for You
Proving catastrophic impairment is not automatic. The burden of proof is on you, and strong medical evidence is essential — particularly for claims falling under Criteria 6, 7, or 8.
Insurance companies often dispute these designations. Even with supporting medical reports, they may require you to attend insurer examinations. If necessary, a hearing before the Licence Appeal Tribunal may be required to secure the designation.
